A Waterford District Court judge has refused jurisdiction in a case of a man who broke into a woman’s home in the middle of the night. 

Clive Hennessy (40) of 203 Clonard Park, Ballybeg, Waterford, was charged with trespassing, contrary to Section 12 (1) (b) and (3) of the Criminal Justice (Theft and Fraud Offences) Act, 2001, relating to an incident that occurred on 11 September, 2025. 

For the purposes of jurisdiction, Sergeant John Phelan outlined to the court that on that day, the injured party returned to her home at the Upper Yellow Road, Waterford city after 1:00am, and discovered an unknown man in her sister’s room. The man, who was identified as the accused, was arrested by Gardaí. 

Judge Kevin Staunton decided to refuse jurisdiction in the case, which will transfer it to the and remanded the accused on bail until 24 February next, when the case will be mentioned again.
