A man who was found by Gardaí to be shouting “aggressively” while out in Waterford over Christmas was recently given the benefit of the doubt, by having his case struck out.

Anthony Flynn (46) of 49 Kilcohan Park, Waterford, appeared before Judge Kevin Staunton at a sitting of Waterford District Court in January, and pleaded guilty to charges of abusive behaviour and being intoxicated in public, relating to an incident where he encountered Gardaí at an area in Waterford city on 25 December, 2025.

The court heard that shortly before 12:00am on the night, Gardaí encountered a man who was “shouting aggressively” and telling them that he “wants to fight.” The man, who was identified as the accused, was subsequently arrested.

Acting for the defendant, solicitor Derrick Connors outlined that his client has no previous convictions, and suffers with mental health conditions such as psychosis, as well as depression and anxiety. He stated that on the night, after the accused had a drink, it reacted badly with his medication, and before he encountered Gardaí, he was allegedly assaulted by someone known to him.

Judge Staunton said that he would give the accused the benefit of the doubt, and decided to strike out the case.
