Gardaí had to pepper-spray a non-compliant young man who was acting in an “aggressive” manner, while on a night out in Waterford last year, the District Court heard.
Danny Guiry, of 4 Marine Drive, Waterford was before Judge Kevin Staunton at a sitting of Waterford District Court earlier this month, charged with being intoxicated in public, contrary to Section 4 of the Criminal Justice (Public Order) Act, 1994.
Inspector Niall Daly told the court that Gardaí were out on patrol in the early hours of 25 September, 2025 on John Street, Waterford, when they encountered a man, who was allegedly acting “aggressively” and was unsteady on his feet.
The man, who was identified as the accused, was later pepper-sprayed by Gardaí after it was alleged that he would not comply with being arrested.
It was stated that the accused has previous convictions, which include public order matters.
Acting for the defendant, solicitor Ken Cunningham outlined that his client is living with several medical conditions, and has nothing else pending before the courts.
After stating that the accused “should probably stay off drink”, Judge Staunton handed him a €250 fine.
