A man who was described as being “known to the courts” had a drugs possession charge dismissed under the Probation Act.
Dean Byrne (24) of 11 Larchville, Waterford, pleaded guilty to possessing a controlled substance (namely cannabis) for his own personal use contrary to Section 3 of the Misuse of Drugs Act at a recent sitting of Waterford District Court.
The charge related to €80 worth of cannabis that was discovered by Gardaí following a search of the accused’s house on 9 May this year.
The court heard that the accused co-operated with Gardaí and “took ownership immediately” of the drugs, admitting to possessing them for his own personal use.
Acting for the defendant, solicitor Hilary Delahunty said the accused is “known to the court” and that they “didn’t have to list his previous convictions”.
Mr. Delahunty highlighted that his client has been out of trouble for the past year-and-a-half, has been going to counselling and “seems to be doing somewhat well”.
Judge Kevin Staunton dismissed the charge under Section 1 (1) of the Probation Act, 1907, acknowledging that he had not seen the accused in court for a while, and wished him well.
