A Wexford  man who used “strong language” towards Gardaí while drunk was recently ordered to make a donation to the court poor box to avoid a conviction. 

Cormac Byrne (22) of 31 Glenbrook, Newtown Road, Wexford,  appeared before Judge John Cheatle at a sitting of Waterford District Court last December, and pleaded guilty to two charges contrary to Section 4 and 6 of the Criminal Justice (Public Order) Act, relating to an incident that occurred in Waterford city on 4 December 2025.  

The court heard that during the early hours of the night in question, Gardaí were called to a takeaway on John Street, Waterford, after a ‘scuffle’ between customers was reported to them. The accused was identified as being involved, and then became abusive to Gardaí, using “strong language.” He was subsequently arrested. 

It was noted in court that he has no previous convictions. 

Addressing the defendant, Judge Cheatle highlighted that if someone pleads guilty at the first opportunity, that they are usually invited to make a donation to the court poor box. Judge Cheatle asked the accused if he would like the opportunity to do this, which the accused indicated he would. 

Judge Cheatle invited him to make a €100 donation to the court poor box, indicating that the case would be struck out if this was completed. It was later struck out after the donation receipt was presented to Judge Cheatle.
