A young man who had “too much alcohol” while on a Christmas night out was recently ordered to make a donation to the court poor box to avoid a conviction.
Kelvin Kelly (22) of 7 Hillside Close, Kilmacthomas, Waterford, appeared at a sitting of Waterford District Court recently, charged with being abusive and intoxicated in public, which related to an incident that occurred on 24 December, 2025.
The court heard that on that night, Gardaí were on patrol at John Street, Waterford, when they encountered a man who was intoxicated and ‘aggressive’. The man, who was identified as the accused, was observed to be unsteady on his feet and had glossy eyes. It was also noted that there was a strong smell of alcohol coming from him.
The defendant was present in court and when addressed by Judge Staunton, he apologised for his actions. He said: “Sorry for what I did, I had too much alcohol.” The court was also told that the accused has no previous convictions.
Judge Staunton said he would give the accused an opportunity to avoid a conviction and invited him to make a €500 donation to the court poor box before 10 March. The Judge indicated that if the donation is made before then, the matter would be struck out.
